PRIVACY POLICY

Gotickety is the trading name for Ratchet Entertainment, a company registered in United Kingdom under number 10877244 whose registered office is at 1st Floor, 2 Woodbury Grove, Finchley, London, United Kingdom, N12 0DR (“Gotickety”, “we”, “us” or “our”). For the purposes of this Policy, Gotickety is the data controller of all personal data and its Data Protection Officer is Christopher Piper, chris@gotickety.com. The Data Protection Officer is responsible for administering this Policy and for developing and implementing any applicable related policies, procedures, and/or guidelines.

This privacy policy sets out how Gotickety uses and protects any information that you give when you use this website or provide personal data when you register with our app. Gotickety is committed to ensuring that your privacy is protected. You can be assured that all personal data that you provide will only be used in accordance with this privacy statement.

This policy is effective from October 2019.

What We Collect

When you register, we will collect the following information:

  • First and last name;
  • contact information, including email address and phone number;
  • demographic information such as address, preferences and interests;
  • date of birth; and
  • other information relevant to your playing habits We also collect information from you where you contact us with any query or issue and if you choose to subscribe for marketing as explained in more detail below.

    Each time you visit our website or open our app, we will automatically collect the following information:

  • Technical information that your browser sends whenever you visit a website, or your mobile app sends when you are using it. This log data may include your Internet Protocol (IP) address, the address of the page you visited, your browser type and settings, the date and time of your visit or use of the app, information about your browser configuration and plug-ins, language preferences.
  • Information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from our website (including date and time); content you viewed or searched for; page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.
  • Certain cookie or similar technology data, which we explain in more detail below.

    Childrens’ Data

    You must be over certain age to play our games and use our Services, depending on where you live and according to conditions set out by the store where you download the app.

    We do not knowingly collect or solicit personal information, or direct, or target advertising or our services to anyone under the age of thirteen. If you believe that we might have any information from or about a child under this age, please contact us.

    What We Do With The Information We Gather

    We use your registration information to register you for the service and to allocate prizes. This is necessary for us to provide the services to you.

    We use information you provide to us if you choose to contact us with a query or issue in order to respond to you. We may also need such information about you and the issue in order to resolve it and, in some cases, to enforce our terms or defend ourselves from legal claims.     Where you choose to subscribe to get information from us or your favourite artist/record company, we get your consent for this. You can change your mind and unsubscribe at any time as explained below.

    We may also use your information for our internal record keeping and administration, which is necessary for our legitimate interests.

    Disclosure of your information

    We may share your personal data with selected third parties including:

  • Suppliers and sub-contractors for the performance of any contract we enter into with them and for the purposes of providing part of our service to you. Such third parties supply the hardware infrastructure, storage and associated services necessary for us to provide our services. All information submitted to third parties will be encrypted using SSL technology. These companies are all suppliers processing your data on our behalf and they can’t use your data for their own purposes. We always make sure such suppliers are subject to strict contractual obligations.
  • Business partners/artists who may use your personal data to send you marketing content. This will only occur with your consent, which we will seek from you via the app, and which you may withdraw at any time as explained below. We will always set out the name of the relevant business partner/artist when we ask for your consent.
  • Companies behind any third party cookies or similar technologies as explained in the cookie section below. We may also disclose your personal data to third parties:
  • In the event that we sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets.
  • If we are under a duty to disclose or share your personal data in order to comply with any legal obligation, or in order to enforce or apply our user terms and/or any other agreements; or to protect the rights, property, or safety of Ratchet Entertainment, our clients, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

    Security

    We are committed to ensuring that your information is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect within the app.

    Where we have given you (or where you have chosen) a password which enables you to access certain parts of the app or website, you are responsible for keeping this password confidential. We ask you not to share any password with anyone.

    Links to other websites

    Our app may contain links to websites of interest. However, once you have used these links to leave our app, you should note that we do not have any control over that other website. Therefore, we cannot be responsible for the protection and privacy of any information that you provide whilst visiting such sites and such sites are not governed by this privacy statement. You should exercise caution and look at the privacy statement applicable to the website in question.

    Transferring your data overseas

    The personal data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (the European Union Member states, plus Norway, Iceland and Liechtenstein). It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Such staff may be engaged in, among other things, the provision of support services. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and we will ensure that appropriate safeguards have been put in place to protect your information. This will normally be in the form of Standard Contractual Clauses adopted by the European Commission.

    Controlling your personal information

    Please contact our Data Protection Officer (see above) if you wish to exercise any of your rights described in this section.

    Consent.

    If you subscribe to our marketing communications, we will use your name and email address to send communications to you. You may elect to stop receiving our marketing emails by following the unsubscribe instructions included in such emails. If you no longer want to receive marketing from a third party, you will need to withdraw your consent directly with them.

    We may send push notifications from time to time in order to update you about events and promotions we may be running. We obtain your consent for this. If you no longer wish to receive these communications, please disable these in the settings on your device.

    Access to information.>

    You have the right to access information we hold about you. If you exercise this right, we may ask you to verify your identity, or ask for more information about your request (and where we are legally permitted to do so we may decline you request (but we will explain why if so).

    Right to deletion, rectification, restriction and portability.

    You have the right to request that we erase your data in certain circumstances, or to rectify, restrict or port information you have provided to us. Please be aware however that these are not absolute rights and, depending on the scope of your request, it may not be something we are legally required to do or it may be subject to relevant exemptions.

    Retention.

    We will retain your personal data for so long as we have a business need to do so, or for such longer period as we believe in good faith that the law or relevant regulators require us to preserve it. We will periodically review our retention policy to ensure that we are not retaining your personal data for longer than necessary.

    This is to enable us to comply with our legal obligations (including potential law enforcement requests), meet regulatory requirements, maintain security, prevent fraud and abuse, resolve disputes, enforce our contractual terms, offer new features you may be interested in, or fulfil your request to “unsubscribe” from further messages from us.

    Automated Decision Making.

    We don’t use any automated decision making. This means we don’t use technology to make decisions about you that may have a significant effect on you without human intervention.
